Discuss the role of the Competition Commission of India in containing the abuse of dominant position by the Multinational Corporations in India. Refer to the recent decisions.

Established under the Competition Act, 2002, the Competition Commission of India (CCI) is mandated to prevent anti-competitive practices, promote and sustain market competition, protect consumer interests, and ensure freedom of trade in Indian markets.   • Enforcing Behavioral and Structural Remedies: Directs corporations to cease unfair contract terms, modify exclusive distribution agreements, or open platform APIs to third-party competitors.
  • Imposing Financial Penalties: Penalizes non-compliant enterprises up to statutory limits based on global or relevant turnovers.
  • Absorbing the National Anti-Profiteering Authority (NAA): Takes over anti-profiteering oversight to ensure corporate compliance with tax reductions.

Key Decisions and Interventions Involving MNCs

  • Antitrust Action Against Google (Android Ecosystem):
    • The CCI imposed a penalty exceeding ₹1,300 crore on Google for abusing its dominant position in the Android mobile device ecosystem. The CCI directed Google to cease mandatory pre-installation of its search app and Chrome browser, and permit third-party app stores on Google Play.
  • Probe into WhatsApp/Meta Data Sharing Policy:
    • Initiated an inquiry into WhatsApp’s updated privacy policy, examining whether its “take-it-or-leave-it” terms leveraged dominant market position to share user data across other corporate products.
