Under Article 76 of the Constitution, the Attorney General for India (AGI) serves as the highest law officer in the country, functioning as the chief legal adviser to the Union Government and representing the State in complex constitutional litigation.

Responsibilities of the Attorney General

  • Legal Counsel to the Union (Article 76(2)): Advises the Government of India on legal matters referred by the President, assisting in evaluating constitutional questions and policy decisions.
  • Defending the Union in the Judiciary: Appears on behalf of the Government of India in the Supreme Court and various High Courts in cases involving the Union (Article 76(3)), including Presidential references under Article 143.
  • Discharging Assigned Legal Duties: Carries out statutory duties assigned under the Constitution, law, or specific executive mandates.
  • Assisting Lawmaking: Reviews legislative drafts and proposed bills to ensure conformity with constitutional norms and fundamental rights.

Rights of the Attorney General

  • Right of Audience (Article 76(3)): Entitled to appear and be heard in all courts across the territory of India in the discharge of official duties.
  • Parliamentary Participation (Article 88): Possesses the constitutional right to speak in, and take part in the proceedings of, both Houses of Parliament, joint sittings, and parliamentary committees of which he may be named a member.
  • Privileges and Immunities: Enjoys the parliamentary privileges, legal immunities, and protections accorded to Members of Parliament under Article 105.
  • Confidential Communications: Consultations between the AGI and the Union Government are privileged and protected by professional confidentiality.

Limitations and Constraints

  • No Voting Rights in Parliament (Article 88): Cannot cast a vote in parliamentary divisions or committee proceedings despite attending debates.
  • Advisory Rather than Executive Authority: Functions as a legal counsel without administrative decision-making authority or political office.
  • Restrictions on Private Practice: As a constitutional officer, the AGI cannot advise or hold briefs against the Government of India, nor defend accused persons in criminal prosecutions without central government permission.
  • Tenure Dependent on Pleasure: Appointed under Article 76(1), holding office during the pleasure of the President; conventionally tenders resignation upon a change of government.
